Life line: What’s right about wrongful death
No question, it’s very difficult to find positives when a loved one or acquaintance dies a “wrongful” death. But if there is a silver lining, it boils down to the potential for compensation: Throughout America’s common-law jurisdictions, including Houston, monetary damages are available through wrongful death lawsuits.
By definition, such a death occurs when an individual is killed due to negligence or similar type of improper action by another; the survivor’s next of kin are entitled to financial remuneration, if the instigator’s conduct is deemed unjust. (It’s against the law, of course, for the deceased to bring a lawsuit, so a loophole was made to enable a civil sanction to be possible if one person’s activities led to another’s death.) The tort law of any given state such as Texas determines liability.
If a survivor is going to sue somebody, it’s important to keep in mind a few particulars about wrongful death claims: Was the defendant liable or negligent for the death? Has the victim’s death result in monetary problems? And is there a spouse, child or other beneficiaries or dependents? Those factors come into play, so it’s imperative to think about them when pursuing a claim, attorney and court case.
Reparations may encompass hospital and funeral-related expenses, losses sustained by the decedent’s spouse or kids, and even compensation for any pain the victim may have endured. There’s a downside that tends to creep up, however: Mind games and jockeying among survivors, for position and influence.
